Education Law Section 2-d provides guidance to educational agencies and their third-party contractors on ways to strengthen data privacy and security to protect student data and annual professional performance review data. The Board of Regents adopted Part 121 of the Regulations of the Commissioner of Education on January 13, 2020.

The Clarkstown Central School District established the parental bill of rights in recognition of the risk of identity theft and unwarranted invasion of privacy. CCSD affirms its commitment to safeguarding student personally identifiable information (PII) in educational records from unauthorized access or disclosure in accordance with State and Federal law. Parents should be aware of the following rights they have concerning their child’s data:

Yes. Software (programs/web-based applications) used in CCSD is evaluated to ensure compliance with New York State Education Law 2-d. A list of the District's approved web-based applications that underwent a comprehensive screening process can be found here: CCSD Approved Technology List.

Please note: Approved Google extensions are based on our approved software inventory list. Google Chrome extensions are typically created by third-party vendors and do not fall under our data privacy agreement with Google. The majority of extensions are not part of the Google for Education Suite. 

Be mindful of websites that allow a "Sign in with Google." This does not necessarily mean it is permissible to access that site using your CCSD Google account credentials. Signing in with Google often passes data unbeknownst to the user. Web-based applications should not be used, unless they are on the approved list mentioned above.

A complaint may be made by a parent(s) or guardian(s) of a student, eligible student (at least 18 years of age), principals, teachers and employees of an educational agency. 

Please complete the Improper Disclosure Form thoroughly, including sufficient details that will allow the complaint to be investigated. By filing this form, you are filing a complaint with the NYSED Privacy Office alleging that PII has been disclosed to, or accessed by, an unauthorized person. Please do NOT include any information in the form that would constitute student, teacher or principal PII. NYSED will contact you if additional information is needed.

The Family Educational Rights and Privacy Act (FERPA) affords parents/guardians and students over 18 years of age (eligible students) certain rights with respect to the student’s education records. For a full list of your rights under the Act, view Board of Education Policy 5500-E.1. Annual FERPA notifications may be found here.
